New regular on the Annual Health Check for Female employees effective from 20 June 2023

Dear Valued Client,

 

We would like to update new regular that affect the HR operation as follow:

 

1. New regular on the Annual Health Check for Female employees effective from 20 June 2023.

 

In accordance with Circular No. 09/2023/TT-BYT, dated 05 May 2023, it is mandatory for the periodic health checkups of female employees to align with the contents specified in the newly introduced periodical health examination form, as detailed in Appendix 3a. Furthermore, it is required to supplement the obstetric and gynecological examinations, as outlined in Appendix 3b, which accompanies the aforementioned Circular.

 

Effect to employer

 

- Increased Employment cost.

 

     + Annual Health Check Budget for female increase.

 

2. New regular on the protection of personal data effective from 1 July 2023.

 

According to Decree No. 13/2023/ND-CP issued on 17 April 2023, it is mandatory for companies to get employees’ agreement on requesting, archiving and handling employees’ personal information from 1 July 2023.

 

Detail process and requirements will be updated in a separate email soon.

 

Effect to employer

 

- Increased company procedure and workload.

  

     + News process and documents related to an agreement between employer and employee about personal data.

 

3. New regular on the change of Statutory Pay Rate effective from 1 July 2023.


According to Decree No. 24/2023/ND-CP, issued on 14 May 2023, the statutory pay rate is increased from 1,490,000 VND/month to 1,800,000 VND/month which is going to take effect from 01 July 2023. Relating to the adjustment of the statutory pay rate, the maximum salary for Social Insurance (SI), Medical Insurance (MI) and Trade Union funds (TU) will be 36,000,000 VND/month (currently 29,800,000 VND/month), as detailed below.

Effect to employer

 

- Increased the Employment Cost of employees with salary greater than the Cap rate.

 

     + The salary cap for SI and MI is changed accordingly, the contribution of SI and MI increases.

 

     + The maximum Trade Union funds is changed accordingly, equal to 2% of the salary cap for SI.
